Summary of the Latest Amendment to the Property Law for Turkish Citizenship
The General Directorate of Land Registry and Cadastre in Turkey approved some changes in the procedures for purchasing property to acquire Turkish citizenship, published them in the administrative regulations guide on Turkish citizenship, and announced that these should be implemented as of 2015. Latest changes regarding controls on owning property for the purpose of Turkish citizenship

1. A contract condition (in referral sales contracts):
According to the new regulation regarding foreign real estate investors who want to apply for Turkish citizenship, especially forward sales contracts; Since it is possible to purchase more than one property up to US$ 400,000, which is the value determined in the application for Turkish citizenship, the collection of real estate purchased with a single sales contract has become a binding issue in terms of property ownership in acquiring Turkish citizenship. They should all be in one forward sales contract, not in multiple contracts. Likewise, in forward sales contracts, these contracts are concluded on the real estate on which a floor easement or condominium ownership has been concluded, that is, the seller who does not have a floor easement or condominium ownership; A forward sales contract cannot be made to a foreign buyer who wants to apply for Turkish citizenship in exchange for real estate.
2. Mortgaged property is not accepted in citizenship procedures:
With the new amendments, it has been ruled that the foreigner’s request to acquire Turkish citizenship will not be accepted in exchange for a real estate share in real estate acquired between two or more partners, even if the value of the share exceeds the amount required for citizenship.
This means that the real estate or property whose owner will apply for Turkish citizenship must be the exclusive property of the applicant.
3. The property purchased within the scope of the plan does not give the owner the right to apply for Turkish citizenship:
In other words, the real estate purchased in order to acquire Turkish citizenship must not be off-plan and must be a real estate whose construction has started. Any medicine that violates this condition will not be accepted in the Turkish citizenship application process.
4. The real estate sold by a foreigner to a Turkish citizen within the last three years does not make the buyer a candidate for citizenship:
Article 3 of the paragraph regarding the parties to the contracts in the Turkish citizenship application guide stated: Any real estate sold by a foreign owner to a Turkish citizen or a Turkish company in the last three years; It will not be accepted for Turkish citizenship applications.
5. Real estate valuation reports received before the sale are invalid:
That is: Any real estate valuation report received before starting the real estate purchase transaction; It will not have legal validity in transactions aimed at determining the value of property owned for the purpose of acquiring Turkish citizenship.
6. Property purchased from a Turkish citizen who is close to a Turkish citizen or who has exceptionally acquired citizenship is not eligible for citizenship:
The amendments also included conditions that must be met on the property in order for the woman to be allowed to apply for Turkish citizenship: the property must not be sold by a Turkish citizen who is related to the foreign buyer, and the property must not be sold. 7. Other properties that will not make the buyer a candidate for Turkish citizenship:
In the said changes, it was also stated that any real estate with a legal mortgage will not nominate its foreign buyer for Turkish citizenship and will not be accepted in its transactions.
